1. Who we are

This website, time4diamonds.com, is operated by Time 4 Diamonds DMCC Ltd, a company registered in England and Wales under company number 09702973, with its registered office at 1st Floor, 3 More London Riverside, London SE1 2RE, United Kingdom. In these terms, "Time 4 Diamonds", "we", "us" and "our" refer to Time 4 Diamonds DMCC Ltd.

By placing an order through this website, by phone, by WhatsApp or in one of our showrooms, you agree to these terms. Please read them before ordering. Nothing in these terms affects your statutory rights as a consumer.

2. Independent retailer

Time 4 Diamonds is an independent retailer of pre-owned and customised luxury watches and jewellery. We are not affiliated with, endorsed by, sponsored by or connected to Rolex SA, Audemars Piguet, Patek Philippe, Cartier, Hublot, Richard Mille or any other watch or jewellery manufacturer mentioned on this website. All brand names, model names and logos are trademarks of their respective owners and are used solely to identify the products we sell.

Watches described as customised, diamond set or bespoke have been modified by Time 4 Diamonds or on our behalf. These modifications are not carried out, approved or endorsed by the original manufacturer.

3. Products and descriptions

Most watches we sell are pre-owned. Each listing describes the condition, included accessories (such as box and papers) and any modifications as accurately as we can. Photographs show the actual watch offered for sale unless the listing states otherwise. Minor variations in appearance may occur due to screen settings.

Pre-owned watches may show signs of previous ownership consistent with their described condition and age. Such characteristics do not constitute a fault or defect where they are consistent with the product description.

Every watch we sell is inspected and authenticated by our in-house watchmakers before dispatch. If we find after sale that a watch is not authentic, we will provide a full refund.

4. Customised and bespoke watches

Diamond setting, dial changes and other customisation work permanently modify the original watch. You acknowledge and agree that:

• Customisation voids any remaining manufacturer warranty on the watch. The manufacturer may refuse to service a customised watch.
• Customisation may affect the future resale value of the watch, positively or negatively.
• Customised and bespoke items are covered by the Time 4 Diamonds warranty described in section 8, not by any manufacturer warranty.
• Work commissioned to your specification (including customisation of a watch you supply or a watch you select for customisation) is made to your personal specification. Under regulation 28(1)(b) of the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, the 14 day cancellation right for distance sales does not apply to such items. This does not affect your rights in respect of faulty goods.

Where you supply your own watch for customisation, you confirm that you are the legal owner of the watch and that it is not subject to any finance agreement, charge or third party claim.

5. Ordering and payment

All orders are subject to acceptance and availability. A contract is formed when we confirm dispatch of your order or, for bespoke commissions and sourcing requests, when we confirm the commission in writing and receive any agreed deposit.

Prices are shown in pounds sterling and include UK VAT where applicable. Delivery charges, import duties and taxes for international orders are the responsibility of the customer unless stated otherwise at checkout.

Despite our best efforts, a small number of products may occasionally be mispriced. If the correct price is higher than the price stated at checkout, we will contact you before dispatch and give you the option to proceed at the correct price or cancel with a full refund. We are not obliged to sell at an obviously incorrect price.

Deposits paid for sourcing requests and bespoke commissions are non-refundable once we have begun work or committed funds to acquire the requested item, except where required by law or where we are unable to fulfil the commission.

6. Identity and payment verification

Because we trade in high value goods, we may carry out identity, address, payment and anti-money-laundering checks before accepting or dispatching an order. We may request proof of identity and proof of address. We reserve the right to delay dispatch pending verification, or to cancel an order and refund payment where checks cannot be completed to our satisfaction. We may refuse cash payments above thresholds set by applicable anti-money-laundering regulations.

7. Delivery and risk

All watches are sent by fully insured, tracked and signature-required courier. Risk in the goods passes to you on delivery. Ownership passes when we receive payment in full, including any applicable delivery charges.

You must inspect the package on delivery and notify us within 48 hours of any damage or discrepancy. For international deliveries, you are responsible for ensuring the goods may lawfully be imported into the destination country.

8. Warranty

Watches sold by Time 4 Diamonds are covered by our own 12 month mechanical warranty from the date of delivery, covering the movement against manufacturing and workmanship defects. The warranty does not cover damage caused by accident, misuse, water ingress beyond the stated resistance, unauthorised repair or normal wear including scratches to the case, bracelet, crystal or diamond settings.

This warranty is in addition to, and does not limit, your statutory rights under the Consumer Rights Act 2015, including the right to reject faulty goods within 30 days and remedies for goods that are not as described or not of satisfactory quality.

9. Returns and cancellation

Our returns process, timescales and conditions are set out in our Refund Policy, which forms part of these terms. In summary, standard pre-owned stock purchased at a distance may be returned in accordance with your rights under the Consumer Contracts Regulations 2013, provided the watch is returned in the condition supplied with all tags, seals, accessories and documentation. Bespoke and customised commissions are excluded from the change-of-mind cancellation right as described in section 4. Nothing in this section limits your rights in respect of faulty or misdescribed goods.

10. Selling your watch to us

Where you sell a watch to us, you confirm that you are the legal owner, that the watch is not stolen, counterfeit or subject to any finance agreement and that you have the right to sell it. Our purchase offers are conditional on physical inspection and authentication. We may adjust or withdraw an offer if the watch does not match its description on inspection. We report suspected stolen goods to the relevant authorities and cooperate with police enquiries.

11. No investment advice

Watches and jewellery are consumer goods, not financial products. Any commentary on this website about market values, past price performance or collectability is provided for general interest only and is not financial or investment advice. Past performance is not an indicator of future value. Values can fall as well as rise. Time 4 Diamonds is not authorised or regulated by the Financial Conduct Authority and does not provide regulated financial services.

12. Website use and intellectual property

All content on this website, including text, photography, video and design, is owned by or licensed to Time 4 Diamonds and protected by copyright. You may not reproduce, scrape or republish our content without written permission. Product photography of our watches may not be used to advertise goods for sale elsewhere.

You must not use this website in any way that is unlawful, fraudulent or harmful, or attempt to gain unauthorised access to our systems.

13. Liability

Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any liability that cannot be excluded under English law, including your statutory rights under the Consumer Rights Act 2015.

Subject to the above, we are not liable for losses that were not foreseeable when the contract was made, losses not caused by our breach or business losses where you purchase as a consumer. Our total liability in connection with any order is limited to the price paid for that order.

14. Events outside our control

We are not responsible for delay or failure to perform caused by events outside our reasonable control, including courier failures, customs delays, supplier failures or interruptions to payment systems. If such an event substantially delays your order, you may cancel and receive a refund for undelivered goods.

15. General

If any provision of these terms is found to be unenforceable, the remaining provisions continue in full force. These terms constitute the entire agreement between you and us in relation to purchases from this website. We may update these terms from time to time; the version in force at the time of your order applies to that order.

16. Governing law

These terms are governed by the law of England and Wales. You may bring proceedings in the courts of England and Wales. If you are a consumer resident in Scotland or Northern Ireland, you may also bring proceedings in your local courts. Purchases made at our Dubai showroom may be subject to separate terms provided at the point of sale.
